This is an application for anticipatory bail for the offences under Sections 461 and 379 of the Indian Penal Code. It has been submitted by the learned counsel for the petitioner that as a matter of fact the petitioner has not taken away the files and a departmental proceeding has been initiated against him. It is further submitted that the petitioner is about to superannuate from service.

Heard learned A.P.P. appearing for the State. He has pointed out that the complicity of the petitioner has come in para 13 of the case diary.

Aditi Gupta, learned Judicial Magistrae,1st Class, Patna, in Shastri Nagar P.S.Cae No. 433 of 2016, subject to the condition as laid down u/.s 438(2) Cr.P.C. and further that the petitioner will co-operate in the departmental proceeding as well as in investigation, as and when required by the officers.
