The petitioners apprehend their arrest in connection with Hasanpur P.S. Case No.61 of 2017 registered under Sections 147, 148, 323, 307, 354 and 504 of the Indian Penal Code. The accusation is that on 12.05.2017, in the noon, the informant Munchun Kumari was standing at the door of her maternal uncle Sri Prahlad Das. At that time, six persons, named in the F.I.R., including the petitioners came and started to abuse and assault to the informant through lathi, iron rod, bricks and stones causing blood oozing injury on her head. Patna High Court Cr.Misc. No.51155 of 2017 (3) dt.02-11-2017 2/3 Kumari and Rani Kumari rushed to save the informant, they were also assaulted by them.
Learned counsel appearing on behalf of the petitioners submits that, in fact, the shop of the informant and the shop of Sri Prahlad Das, the maternal uncle of the informant, is situated at the same place, due to that reason, there was some dispute and the occurrence of "Maar-Peet" was taken place in between them regarding which Hasanpur P.S. Case No.106 of 2014 was instituted by the petitioner no.2 Ranju Devi, the wife of the petitioner no.1. The informant has lodged the present case only to put undue pressure upon the petitioners. Further submission is that Babibta Devi, wife of Sri Prahlad Das, the wife of the maternal uncle of the informant, has also lodged Hasanpur P.S. Case No.60 of 2017 regarding the same occurrence against the petitioner nos.1 to 4 and one Pappu Das. Moreover, the injuries, as found on the person of the informant, are simple in nature caused by hard and blunt substance.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.51155 of 2017 (3) dt.02-11-2017 3/3 satisfaction of the Additional Chief Judicial Magistrate-III, Rosera, Samastipur, in connection with Hasanpur P.S. Case No.61 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
