This application for anticipatory bail arises out of Goreya Kothi P.S. Case No. 196 of 2018 for the offence punishable under Sections 304B/34 of the Indian Penal Code. The petitioner nos. 1 and 2 are the brothers of the husband of the deceased. Petitioner nos. 3 and 4 are father-inlaw and mother-in-law of the deceased. About petitioner no. 5, it is stated that he had negotiated marriage between the deceased and the co-accused, Ajay Ram. Refering to the First Information Report, learned Counsel appearing on behalf of the petitioners has submitted that there is general and omnibus allegation against all the

Patna High Court CR. MISC. No.26007 of 2019(2) dt.22-04-2019 2/2 members of the family of demand of dowry. There is allegation that these petitioners were instrumental in getting the deceased killed, but no basis has been disclosed in the First Information Report in support of the said allegation.

Considering the facts and circumstances, this application is allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Goreya Kothi P.S. Case No. 196 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
