No one appears on behalf of the State.

A supplementary affidavit has been filed enclosing the injury sustained by the petitioner.

The petitioner prays for grant of anticipatory bail in Warisaliganj P.S. Case No. 112 of 2016 registered under section 307 IPC.

On account of construction of a road and removal of soil from the land of the petitioner, it is alleged that a scuffle took place wherein the petitioner is said to have assaulted by means of a handle on the head and leg of the informant. Other accuseds are said to have assaulted the uncle of the informant. The contention of the petitioner is that for a small issue both parties fought for which the case and counter case have been

He is neighbour of the informant. If granted the privilege of anticipatory bail, he shall not indulge in commission of any such crime.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Nawada in Warisaliganj P.S. Case No. 112 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
