====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 09-03-2022 Heard learned counsel for the petitioners and learned APP for the State.
Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioners apprehend their arrest in connection with Garkha P. S. Case No. 297 of 2020 registered for the offences punishable under Sections 341, 323, 447, 307, 379, 504, 506 and 34 of the Indian Penal Code.
At the very outset, learned counsel for the petitioners seeks permission to withdraw the present application as the
Patna High Court CR. MISC. No.36824 of 2021(2) dt.09-03-2022 2/2 petitioners No. 1 and 3 have been arrested and the same has become infructuous against petitioners No. 1 and 3. It is, thus, dismissed as withdrawn as having become infructuous as against petitioners No. 1 and 3. In view of the fact that there is general and omnibus allegation against the petitioner No. 2 and others have already been arrested, the prayer for grant of anticipatory bail of petitioner No. 2 is allowed.
Accordingly, let the petitioner no. 2 namely, Sujeet Kr. Singh @ Sujit Kumar be released on bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/ (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra in connection with Garkha P. S. Case No. 297 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
