JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-06-2023 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of appropriate writ order or direction to the respondent to pay the arear salary of the petitioner from 2.2.2003 to 8.9.03, to pay the arrear of dearness allowance on the basis of fifth pay revision, revised arrear of on the basis of fifth and sixth pay revision, Salary of first A.C.P. and revised pay scale of Modified second and third A.C.P. and other dues and for grant of all consequencial benefits."

At the outset, the learned counsel for the respondent-

Patna High Court CWJC No.23252 of 2013(2) dt.23-06-2023 2/2 State has submitted by referring to the counter affidavit, filed in the present case, that all the outstanding dues have been paid to the petitioner except the salary of the period 02.02.2003 to 08.09.2003, inasmuch as the petitioner is not receiving the salary for the said period.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the District Magistrate, Gaya to ensure payment of the aforesaid outstanding amount of salary, within a period of four weeks from today, failing which he shall not withdraw his salary.

It shall also be incumbent upon the District Magistrate, Gaya to ensure that all the other outstanding dues are paid to the petitioner forthwith, in case the same have not been paid.

The writ petition stands disposed off on the aforesaid terms.
