JUSTICE RAMESH CHAND MALVIYA ORAL ORDER (Per: HONOURABLE MR. JUSTICE P. B. BAJANTHRI) 22-11-2023 The present MJC/contempt petition is filed for noncompliance of the order dated 13.09.2021 passed in CWJC No. 9338 of 2021. The petitioner was directed to submit representation within a period of four weeks and further there was a direction to the concerned authority to pass a speaking order preferably within a period of three months from the date of its filing along with copy of the order. In other words, concerned respondent was required to comply the order of this Court before March, 2022. However, order of this Court has been complied on 08.11.2023 which is evident from the show
Patna High Court MJC No.825 of 2022(4) dt.22-11-2023 2/2 cause filed today.
2. There is no application for extension of time in CWJC No. 9338 of 2021 so as to comply the order of this Court on 08.11.2023, beyond the time limit stipulated. In other words, after a lapse of time limit, concerned respondent has committed contempt of Courts proceedings instead of taking contempt of Courts action. Having regard to the fact that respondents have complied the order of this Court on 08.11.2023 vide Annexure R - 3 to the show cause filed, we propose to drop the contempt proceedings, subject to payment of litigation cost and it is quantified @ Rs. 5,000/- (Rupees Five Thousand). Cost shall be paid to the petitioner reserving liberty to the petitioner to assail the order dated 08.11.2023, if it is affecting his right, in accordance with law (P. B.
