====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-10-2020 Heard learned counsel for the petitioners and the counsel appearing on behalf of the State.

Petitioners are apprehending arrest in connection with Raghopur (Rustampur O.P.) P.S. Case No. 69 of 2020 for the offence under section 414/34 of the Indian Penal Code and Section 30(a) (d)/41of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioners submits that petitioners have no criminal antecedent.

In the instant case 60 liters of country made liquor was seized on the bank of river Ganga.

Considering the fact that the petitioners have no criminal antecedent and the liquor was seized from the bank of

No.23406 of 2020(2) dt.09-10-2020 2/2 river Ganga, the Court is inclined to grant anticipatory bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Excise, Vaishali at Hajipur, in connection with Raghopur (Rustampur O.P.) P.S. Case No. 69 of 2020 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioners shall deposit Rs. 25000/- cash in the court below and the amount of Rs. 25000/- deposited by the petitioner shall abide by final outcome of the pending criminal case.
