The petitioners apprehend their arrest in connection with Nathnagar P.S. Case No.360 of 2017 registered under Sections 448, 341, 323, 386, 379, 504, 506 and 354-B/34 of the Indian Penal Code. The accusation is that the petitioners alongwith Chhotu Yadav and two unknown boarding on three motorcycles came, surrounded the house of the informant and having armed with weapons started to abuse and entered into the house of the informant. Thereafter, Chhotu Yadav pointed three nut at the temporal region of the husband of the informant saying that as to why the ransom has not been paid. At that time, all started to cause assault to the husband and son of the informant through the butt of the three nut. Chhotu Yadav gave

Patna High Court Cr.Misc. No.51066 of 2017 (2) dt.30-10-2017 2/2 threatening to kidnap the husband and son of the informant if the ransom is not paid and attempted to outrage the modesty of the informant. Out of fear, the informant gave Rs.25000/- as ransom. In that course, Chhotu Yadav snatched the gold chain from the neck of the informant.

Learned counsel for the petitioners submits that the petitioners and the informant are co-villagers and due to land dispute in between them, the informant has lodged the present case. Further submission is that the petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bhagalpur, in connection with Nathnagar P.S. Case No.360 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
