====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sono P.S. Case No. 203 of 2018, registered under Section 304 of the Indian Penal Code.

The accusation is of killing of daughter of informant by her husband and in-laws due to non-fulfillment of demand of dowry and throwing her dead-body in the well. Learned counsel appearing for the petitioner submits that petitioner is the husband of deceased and he has falsely been implicated in this case mere on suspicion. Further submission is that, in fact, deceased, wife of petitioner, fell down in the well and died, but with ulterior motive, the present case has been lodged. Further submission is that the

No.31708 of 2020(3) dt.19-01-2021 2/2 bail prayer of the petitioner was refused on merit on 30.05.2019 vide Criminal Miscellaneous No. 21400 of 2019 with liberty to the petitioner to renew his prayer for bail after nine months, if no substantive progress is made in the trial. Further submission is that while petitioner is in custody since 25.08.2018, but the trial of the petitioner has not been concluded as yet. The report, as called for from the Court of Addl. Sessions Judge-III, Jamui, has been received vide letter No. 50, dated 09.12.2020, which indicates that ten witnesses have been cited in the Chargesheet, but up till now, charge has not been framed due to non-appearance of the accused, who are on bail.

Having regard to the facts and the circumstances of the case and observation made vide order dated 30.05.2019 passed in Criminal Miscellaneous No. 21400 of 2019, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-V, Jamui in connection with Sono P.S. Case No. 203 of 2018.
