2. The petitioner seeks bail in connection with Mohanpur P.S. Case No. 36 of 2025 registered for the offence punishable under Section 69 of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, the petitioner is accused of committing rape with the victim on the pretext of marriage.

4. The petitioner is in custody since 31.01.2025.

5. From the reading of the FIR, it appears that the present is a case of consensual sex between two consenting adults.

6. Considering the aforesaid facts, this application is allowed.
