JUSTICE PRABHAT KUMAR JHA ORAL ORDER 19-11-2016 Heard Sri Ramakant Sharma, learned sr. counsel for the petitioner as well as learned Additional P.P. The petitioner filed this petition for modification of order dated 02.04.2012 by which the petitioner was granted anticipatory bail and at the same time he was directed to appear on each and every date fixed in this case. The court below was also directed to allow the absence of the petitioner on reasonable ground.

From perusal of the report of the SDJM, Buxar, it appears that the case was fixed for argument after adducing the evidence from both sides, but thereafter the complainant filed

Patna High Court Cr.Misc. No.42199 of 2016 (3) dt.19-11-2016 2/2 petition and the case is fixed for hearing. On the petition of the complainant, the Court undertakes to dispose of the case within two months. In this view of the fact and in view of the order the case is likely to be concluded within two months. I do not feel inclined to modify the order. The court below has given discretion to allow the petition of the petitioner filed under Section 317 Cr.P.C. as and when required.
