JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-06-2023 Heard learned counsel for the petitioner and the State. The petitioner in the present case is seeking a direction to the respondents to re-name the High School-cumInter College, Kaituka Lachhi, Maker in the District of Saran. According to the petitioner, his ancestor Late Babu Bachchu Narayan Singh had gifted his landed property in favour of the State of Bihar in the year 1961 for establishing a school. The school was established, however, it did not contain the

Admittedly, during his lifetime the ancestor of this petitioner Late Babu Bachchu Narayan Singh never raised any issue with the name of the school. The school was established in the year 1961 but at this stage by virtue of what is said to be a Cabinet decision of the State Government providing for prefixing the name of the donor of the school, the petitioner claims to have made a representation as contained in Annexure '11' to the writ application.

The petitioner has not brought on record the Cabinet decision, hence, this Court has no opportunity to go through the same.

In the opinion of this Court, this writ application is nothing but a misconceived kind of application by the petitioner. He is raising an issue which the donor of the land did not raise at any stage and he remained contented with the name of the school. Such issues cannot be allowed to be opened by filing a writ application.

This application is dismissed.
