The petitioners apprehend their arrest in connection with Khaira P.S. Case No. 73 of 2017 registered under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code. The informant named the petitioners along with other accused persons and alleged that all the accused persons having armed with lathi, stick and iron rod came and assaulted the informant on his nose and one Suresh Ravidas is alleged to have assaulted the wife of the informant.

Learned counsel for the petitioners submits that the informant, Shankar Ravidas got tenderness on nose and another

Patna High Court Cr.Misc. No.34682 of 2017 (2) dt.10-08-2017 2/2 bruise of interior surface of right chest. The injury on nose found to be grievous in nature but omnibus and general allegation is made against the petitioners. It is submitted that some scuffle took place on account of passage in which both the parties indulged in the scuffle and the informant got injury on his nose. Considering the facts aforesaid and the fact that the there is quarrel between the two sides for road and no specific allegation of assault is made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Khaira Police Station Case No. 73 of 2017 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
