2. The petitioner seeks regular bail in the present case registered for the offences punishable under Sections 80 and 3(5) of the B.N.S.

3. As per the prosecution case, petitioner is the husband of the deceased and he is alleged to have killed the deceased for demand of dowry.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is next submitted that the deceased has committed suicide which is apparent from the post-mortem report as apart from the ligature mark, there is no external injury found on the body of the deceased. Learned counsel further submits that though

Patna High Court CR. MISC. No.26131 of 2026(3) dt.01-07-2026 2/2 the petitioner is in custody for the last eight months, the case has still not been committed. Petitioner claims clean antecedent. The petitioner undertakes to co-operate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the post-mortem report, the period of custody and the delay in trial, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Vaishali P.S. Case No. 275 of 2025.

8. As a condition of this order, at the time of acceptance of the bail bond, the court below shall verify whether the case has been committed to the Court of Sessions. If, upon such verification, the statement is found to be true, the bail bond of the petitioner shall be accepted. However, if the case has not been committed to the Court of Sessions, the bail bond of the petitioner shall not be accepted by the court below.
