01-12-2020 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Suppi P.S. Case No. 130 of 2019 registered for the offence under Sections 307, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, this petitioner alongwith other co-accused made indiscriminate firing, as a result of which, the son of the informant sustained fire-arm injury. It is submitted on behalf of petitioner that there is no specific allegation against this petitioner. It is further submitted that the informant, who claims to be eye-witness to the alleged occurrence, has made specific allegation of firing against coaccused Monu Singh, but only due to previous enmity, this petitioner has also been implicated in this case. Patna High Court CR. MISC. No.27613 of 2020(3) dt.01-12-2020 2/2 in custody since 17-08-2019.
However, learned A.P.P. for the State has opposed the bail application and submitted that there is specific allegation of firing against this petitioner alongwith other co-accused. It is further submitted that petitioner has also got criminal antecedent and he is accused in altogether seven cases, as stated in paragraph - 3 of the bail petition.
Considering the aforesaid facts and circumstances, the bail application of petitioner is rejected.
