JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The prosecution case is of abducting the daughter of the informant on 23.7.2015 while she was going to school. On 30.7.2015, the daughter of the informant informed that she has been kidnapped by Rajesh Singh, Mithilesh Singh and Lallu Singh. It is alleged that the petitioner and Babuna Devi being parents of one of the co accused Rajesh Singh also assisted the main accused persons.

It is submitted by the learned counsel for the petitioner that the thrust of accusation even as per telephonic information by

No.56915 of 2015 (2) dt.17-12-2015 2/2 the victim is against the above three named accused persons and the petitioners have only been roped in the present case since he happens to be father of one of the accused. FIR was lodged after 11 days of the actual occurrence. More over, co accused Mithilesh Singh, Lallu Singh and Babuna Devi have been granted bail vide Cr. Misc. Nos. 49046 and 50564 of 2015.

Considering the fact that the victim has named only three persons Rajesh Singh, Mithilesh Singh and Lallu Singh out of whom Mithilesh Singh and Lallu Singh have been granted bail, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Bikramganj, Rohtas in connection with Dinara (Bhanas) P.S. Case No. 264 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
