JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 406, 420, 471 of the Indian Penal Code.
The prosecution case is that the informant, being a cosmetics dealer, started depositing Rs. 100/- in recurring deposit scheme in Motihari Central Co-operative Bank through the petitioner. Altogether Rs. 33,400/- were given to the petitioner to deposit but it is found that only Rs. 23,700/- was ultimately deposited and, hence, Rs. 9700/- was misappropriated by the petitioner. It is submitted by the learned counsel for the petitioner that there is no proof with regard to money given to the petitioner
Patna High Court Cr.Misc. No.6747 of 2016 (2) dt.15-02-2016 2/2 and petitioner, at earlier point of time, lodged Chakia P.S. case No. 189 of 2014 against the son of informant. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Chakia P.S. Case No. 255/ 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) BKS/- U T
