====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-04-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Sessions Trial No. 713 of 2017 arising out of Belchhi P.S. Case No. 11 of 2017, instituted for the offence under Section(s) 394, 302, 34 of Indian Penal Code and Section 27 of the Arms Act. Subsequently, Sections 396, 412 and 120B of the Indian Penal Code has been added.
Counsel for the petitioner submits that petitioner is not named in the written report. His name has come during investigation in the confessional statement of co-accused Lalan Singh. He further submits that co-accused Rajnish Singh @ Rajnish Kumar Singh has already been granted bail by this Court vide order dated 25.3.2019 passed in Cr. Misc. 15902 of 2019.

No.26935 of 2019(2) dt.26-04-2019 2/2 The Sessions Judge has mentioned in the impugned order that on the basis of confessional statement of petitioner and co-accused Lalan Singh, Rs.46,00,000/- has been recovered from the house of Shiv Shankar Singh. Petitioner has been made accused in the instant case because he is son of Shiv Shankar Singh.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-III, Barh, Distt. Patna, in connection with Sessions Trial No. 713 of 2017 arising out of Belchhi P.S. Case No. 11 of 2017, subject to the condition that both the bailors will be close relatives of the petitioner.
