JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being mother of the alleged husband of the complainant is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 323 and 379 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that in fact Vikash Kumar was abducted at the hands of the complainant on 14.12.2014 and forcibly married with the complainant Asha Devi. Subsequently, Vikash Kumar being minor, was found on Nadwa railway station on 21.12.2014 leading to filing of Complaint Case No. 52C of 2015 against the complainant and her family.

No.40031 of 2016 (2) dt.19-09-2016 2/2 Considering the chequered background in which the complainant has claimed her marriage with the son of the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Masaurhi in connection with Complaint Case No. 1 C of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
