Heard both parties.

The petitioner seeks bail in Benipatti P.S. Case No. 17 of 2020, registered for the offence punishable under Sections 498A, 379 and 494 of the Indian Penal Code.

As per prosecution case, the informant was married with this petitioner in the year 2001. After marriage, she went at her sasural. After passing of some years, the behaviour of petitioner with his wife (informant) became harsh. The petitioner came to Mumbai and the informant came to know

Petitioner along with his second wife came to his house. Informant was subjected to torture and cruelty. On 28.01.2020, the petitioner assaulted the informant and her daughter.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Informant her self left her matrimonial house and used to reside at her maike. Petitioner used to take care of informant and her daughter and give money for maintenance of the informant and her daughter on regular basis. Petitioner is in custody since 29.01.2020 having clean antecedent as stated in para 3 of the petition. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I Benipatti, Madhubani in connection with Benipatti P.S. Case No. 17 of 2020, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the
