JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-10-2016 Heard learned counsel for the petitioners, learned counsel for the informant and the learned A.P.P. for the State. The petitioners apprehend their arrest in connection with Taraiya P.S. Case No. 161 of 2016 registered under Section 147, 148, 149, 341, 323, 224, 307 and 379 of the Indian Penal Code.

The accusation is that 16 persons named in the F.I.R. including the petitioners surrounded the cousin and nephew of the informant. When informant made query then Gulam Mustafa Ansari caused injury at his head through Farsa whereas four other persons were also assaulted by the petitioners and others. Learned counsel for the petitioners submits that, in

Patna High Court Cr.Misc. No.43616 of 2016 (2) dt.17-10-2016 fact, occurrence took place due to old enmity, in which, defence side also sustained injury, regarding which, Taraiya P.S. Case is instituted on the basis of written report of co-accused, Samser. Moreover, the injuries found on the person of the injured are simple in nature. It is further submitted that petitioners have no criminal antecedent.

Considering the aforesaid submissions, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Taraiya P.S. Case No. 161 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
