Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Simultallah P.S. Case No. 74 of 2022 registered on 09.08.2022 lodged under Sections 392 of the I.P.C.
As per the prosecution case, F.I.R. has been lodged against three unknown persons.
Learned counsel for the petitioner submits that nothing incriminating has been recovered from the possession of the petitioner nor he was put on T.I.P. Counsel further submits that petitioner has not been named in the F.I.R. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 13.10.2022 having
Patna High Court CR. MISC. No. 27426 of 2023(2) dt.06-06-2023 2/2 one criminal case pending against him, in which he is on bail. Counsel also submits that charge sheet has already been filed in this case. He submits that one co-accused of this case has been granted bail vide order dated 19.05.2023 in Cr. Misc. No. 22644 of 2023 and one another accused has been granted bail under Section 167(2) of the Code of Criminal Procedure vide order dated 11.01.2023 in Cr. Misc. No. 71105 of 2022. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - II, Jamui in connection with Simultallah P.S. Case No. 74 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
