The petitioner seeks bail in Belhar P.S. Case No. 26 of 2013, registered for the offence punishable under Sections 302, 120B and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, 5-6 unknown miscreants came on two motorcycles and fired indiscriminately upon father of informant which hit his head and stomach due to which he died on the spot.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the confession of co-accused Ranjit Kumar Yadav wherein he disclosed that this petitioner used to supply arms to the accused

Patna High Court CR. MISC. No.36795 of 2021(2) dt.10-12-2021 2/2 persons. Co-accused Ranjit Kumar Yadav has already been granted bail by this Court vide order dated 13.02.2014 passed in Cr. Misc. No. 1283 of 2014. Petitioner is in custody since 30.01.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Belhar P.S. Case No. 26 of 2013.
