ANJANA MISHRA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 01.03.2019 in connection with Excise Case No.102 of 2019 registered for the offence under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that only on suspicion, the petitioner was taken into custody and the recovery of spirit as indicated is also a false and fabricated statement as no such recoveries were made and the petitioner had no concern with the co-accused Upendra Gosai. It is submitted that the alleged raid was conducted in serious violation of the provision of Section 100 Cr.P.C.
