The petitioner apprehends his arrest in connection with Barauli P.S. Case No. 155 of 2016 registered under Sections 401, 413, 414, 411, 420, 467, 468 and 471 of the Indian Penal Code. Learned counsel for the petitioner submits that it would appear from the F.I.R. that co-accused, Dharmnath Prasad @ Dharma along with Sanjay Yadav and five others were apprehended by the police near a Bolero vehicle and five motorcycles and on search, one country made pistol was found from possession of co-accused, Dharmnath Prasad @ Dharma, who confessed his gilt about committing theft of motorcycle and
Patna High Court Cr.Misc. No.53331 of 2016 (2) dt.19-12-2016 disclosed that one stolen motorcycle was sold to this petitioner. Thereafter, one motorcycle was recovered from the door of this petitioner. In fact, the motorcycle recovered to the door of the petitioner was purchased by the petitioner from accused, Dharmnath Prasad @ Dharma as bona fide purchaser on 04.07.2016 after verifying the registration of the motorcycle, which was in the name of Dharmnath Prasad @ Dharma. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Barauli P.S. Case No. 155 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
