The petitioner apprehends his arrest in connection with Tr. No.1388 of 2016, arising out of Mirganj P.S. Case No.65 of 2003/G.R. No.606 of 2003, registered under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.
The allegation of the informant Jalaluddin Khan is that Ash Mahammad, Md. Ali and Afzal Ahmad got executed the deed in respect of his property in conspiracy with the deed writer Satish Chandra Srivastava.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.55721 of 2016 (6) dt.04-04-2017 2/2 submits that, in fact, Hafiz Mian executed the gift deed in favour of his grand sons Amir Ahmad and Ash Mahammad on which Krishna Kumar put his signature as a witness. The petitioner has falsely been implicated in this case because he is the brother-inlaw of Ash Mahammad. Further submission is that the petitioner is constable in Army and is posted at Shilong in Gorkha Regiment. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Harshvardhan, Judicial Magistrate, First Class, Gopalganj, in connection with Tr. No.1388 of 2016, arising out of Mirganj P.S. Case No.65 of 2003/G.R. No.606 of 2003, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
