The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner. Recovery is made from the Scorpio vehicle, petitioner is owner of the vehicle. Petitioner has no criminal antecedent and he is a school teacher as well as in charge Principal in Utkramit Madhya Vidalaya, Rupauli Khurd.
Let the petitioner, above named, in the event of his
Patna High Court CR. MISC. No.28657 of 2019(3) dt.22-07-2019 2/2 arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-III cum Special Judge Excise, Samastipur in connection with Ujiyarpur P.S. Case No. 243 of 2018, subject to the conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
