This application, for grant of anticipatory bail, arises out of Sakra Police Station Case No. 56 of 2017, disclosing offences under Sections 147, 148, 149, 323, 341, 384, 427, 307, 354 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner and others is of firing in the Panchayat Bhawan and also of damaging the articles kept there and also of demand of extortion money. Learned Counsel for the petitioner has submitted he has falsely been implicated in this case and no specific allegation has been leveled against him and further the mobile phone from which the extortion was demanded and the motorcycle, do not belong to the petitioner.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.24092 of 2018 (2) dt.02-05-2018 2/2 let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned sub Judge XIII - cum - the Chief Judicial Magistrate, Muzaffarpur, in connection with Sakra Police Station Case No. 56 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure, it is further subject to the condition that:- I.

One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.

II.

The petitioner shall cooperate in the investigation and make himself available as and when required by the police and on the event on failure of his part to appear before the police on two consecutive dates, the prosecution will be free to move for cancellation of his bail bonds.
