====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 19-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

This application has been filed on behalf of the petitioner for modification of the order dated 09.04.2015 passed in Criminal Misc. No.38211 of 2014 by a Bench of this with regard to extend the period of surrender of the petitioner in the court below in connection with Mahila P.S. Case No.127 of 2013. It appears that vide order dated 09.04.2015 passed in Criminal Misc. No.38211 of 2014 by a Bench of this Court, the above named, petitioner, was directed to surrender in the court below and pray for regular bail. If the petitioner may surrender and pray for regular bail, then trial court shall release the

Patna High Court Cr.Misc. No.40873 of 2017 (2) dt.19-09-2017 2/2 petitioner on provisional bail for four months. Thereafter, within one month, the trial court will call the complainant and if the complainant is ready to go with the petitioner and petitioner shall keep the complainant with due dignity and honour then after being satisfied that complainant live with the petitioner, the trial court shall confirm the bail bond of the petitioner. However, if complainant for any unavoidable reason not to live with the petitioner, the petitioner shall pay Rs.1500/- per month as maintenance to the complainant till disposal of the case or higher maintenance is decided by the competent court. I find no reason to modify the order dated 09.04.2015 passed in Criminal Misc. No.38211 of 2014 by a Bench of this Court.
