JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-06-2023 The present writ petition has been filed seeking the following reliefs:- "1. That this is an application for issuance of an appropriate writ/writs, order/orders, direction/directions for the following reliefs:

i. For quashing of the office order as contained in Memo No. 1844 dated 13.12.2012 issued under the signature of the Joint Agriculture Director, Magadh Division, Gaya (Respondent No. 4), by which the benefit of 3rd Assured Career

Patna High Court CWJC No.23810 of 2013(2) dt.23-06-2023 2/3 Progression (hereinafter referred as A.C.P.) has not been given to the petitioner on the ground that departmental proceeding is pending/continued against the petitioner.

ii. Also to direct the respondent BIADA to not give possession of the vacant land bearing Industrial Plot No. F-8 to 12 and N.S. 13 to any other Industrial Unit.

Iii. Also to direct the respondents to give the benefit of 3rd A.C.P. to the petitioner w.e.f. dated on which the juniors to the petitioner has been given i.e. 01.01.2009 and on that day neither any departmental proceeding was pending nor any proposal was given to initiate the Departmental Proceeding."

Considering the nature of prayer made in the present writ petition, I deem it fit and proper to grant liberty to the petitioner to approach the respondent authorities for redressal of his aforesaid grievances in case of any subsisting grievances.
