The petitioner is apprehending his arrest in connection with Patori P.S.Case No.279 of 2017 registered for offences punishable under Section 393 of the Indian Penal Code and Section 27 of the Arms Act.

The matter relates to snatching the motorcycle. Petitioner is not named in the FIR and later on his name transpired during the course of investigation of the case.

Submission of the learned counsel for the petitioner is that except confession of the co-accused there is nothing against the petitioner.

Heard learned A.P.P. also, who has opposed the prayer for bail.

No.13126 of 2018 (2) dt.04-04-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, as well as the criminal antecedent of the petitioner, in my opinion, this is not a case fit for grant of anticipatory bail, let the petitioner surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
