JUSTICE SANDEEP KUMAR ORAL ORDER 24-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Bihpur (Bhawanipur) P.S. Case No. 25 of 2023, registered for the offence punishable under Sections 25(1-b)a/26/35/25(8) of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from the possession of the petitioner. Petitioner has got clean antecedent and he is in custody since 19.01.2023.

Learned APP has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.28995 of 2023(2) dt.24-05-2023 2/2 Considering the nature of allegation levelled against the petitioner and his period of custody, this application is allowed.

Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Ist, Naugachia, DistrictBhagalpur in connection with Bihpur (Bhawanipur) P.S. Case No. 25 of 2023.

This is also subject to the conditions that the petitioner shall mark his presence in Bihpur (Bhawanipur) Police Station, District- Bhagalpur on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
