2. The petitioner has preferred this application for grant of regular bail in connection with Piprahi P.S. Case No. 27/2025 dated 16.02.2025 registered for the offence punishable u/s 308(4) and 308(5) of the B.N.S.

3. As per the prosecution case, unknown miscreant is alleged to have demanded extortion of Rs. 5 lacs from the informant and threatened the informant and his family members to kill, if he would not pay the extortion amount.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious

Patna High Court CR. MISC. No.29410 of 2025(2) dt.12-05-2025 2/3 possession of the petitioner. The petitioner is not named in the F.I.R. No. T.I.P. has been conducted by the prosecution. The name of the petitioner has sprung up in the course of investigation. As per para. 45 of the case diary, the mobile phone from which the extortion call was made to the informant belongs to one Naseem Ansari. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 16.02.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. As per para. 45 and 49 of the case diary, it transpired that the petitioner and the coaccused persons have received call on their mobile phone from the number from which the extortion call was made.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sheohar in connection with Piprahi P.S. Case No. 27/2025, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,

Patna High Court CR. MISC. No.29410 of 2025(2) dt.12-05-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
