Heard the learned counsel for the petitioner, the learned A.P.P for the State and learned counsel for the opposite party no.2.

On behalf of the petitioner the Bihar State Food and Civil Supplies Corporation, it has been submitted that in the order dated 13.12.2016 the petitioner was directed to deposit 4289.23 quintals of CMR within three months which should be modified and the price of the CMR should be deposited by Mukti Prasad Singh within six months.

The learned counsel for the opposite party no.2 Mukti Prasad Singh is ready to deposit the price of 4289.23 quintals of CMR within six months.

Under the circumstances, the order dated 13.12.2016

Patna High Court Cr.Misc. No.20567 of 2017 (4) dt.06-09-2017 2/2 is modified to the extent that Mukti Prasad Singh the petitioner of Cr. Misc. No. 47296 of 2016 shall deposit the price of 4289.23 quintals of CMR within six months in equal installments and then after deposit his ad-interim bail granted shall be confirmed by the learned court below itself and in case of failure his bail granted should be deemed to be cancelled in accordance with terms and conditions of the order dated 13.12.2016 and accordingly this criminal miscellaneous is hereby allowed.
