The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 147, 447, 341, 323, 379, 504 of the Indian Penal Code and 3/4 of the Prevention of Witch Practices Act, 1999.
The prosecution case is that the accused persons assaulted the informant and called her as a witch. It is specifically alleged that co-accused Rajendra Ram assaulted on the nose and mouth of the informant causing bleeding injury from the nose when this petitioner snatched gold top from the informant and co-accused Ashok Ram took away Rs.500/- from
Patna High Court Cr.Misc. No.55586 of 2015 (2) dt.08-12-2015 2/2 the informant.
It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled. Though, the niece of the informant was married with the brother of the petitioner but the marriage could not succeed, hence, in that background the accusation has been levelled. The accusation of assault is not specific against the petitioner, who is a lady.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, East Champaran at Motihari in connection with Madhuban P.S. Case No. 169 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
