JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 448, 341, 323, 307, 379 and 506/34 of the Indian Penal Code. On protest being made for abusing the informant by calling caste name by the accused persons, the informant was assaulted and when the informant went to her house but she was chased and assaulted. It is further alleged that co-accused Karu Rajak assaulted the informant with khanti causing injury on her head, when the husband of the informant came to rescue he was also assaulted by the petitioner no.2 by iron rod causing fracture injury on the palm.

It is submitted by learned counsel for the petitioners that for the occurrence of 06.04.2015 the fardbeyan was recorded on

Patna High Court Cr.Misc. No.55638 of 2015 (2) dt.08-12-2015 2/2 07.04.2015 and the FIR was registered on 05.05.2015. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the specific accusation of assault against petitioner no.2, Gore Rajak, let the learned court below consider the prayer for regular bail of petitioner no.2 if he surrenders within a period of six weeks.

So far as petitioner no.1 is concerned, since no overt act is alleged against petitioner no.1 let the above named petitioner no.1 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Nawada in connection with Akbarpur P.S. Case No. 104 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
