====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 06-05-2025 The petitioner and the complainant are appearing along with their respective counsels in the Chambers proceedings.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 341, 498(A) of the Indian Penal Code.
3. Petitioner, who is husband of complainant, is said to have tortured upon her physically and mentally in association of his family members over the dowry demand.
4. The matter had earlier been sent to the Mediation Centre for resolution of disputes, but the mediation process has failed. Today, after an interaction with the parties and their

No.31676 of 2024(7) dt.06-05-2025 2/3 counsels, it has been agreed that the petitioner would pay a total amount of Rs. 4 lacs to the complainant for full and final settlement of disputes and litigations between the parties. The first installment of Rs. 75,000/- (Rupees Seventy Five Thousand) would be paid before furnishing the bail bonds and the receipt of such payment would be produced at the time of furnishing of the bail bonds. The rest of the amount of Rs. 3,25,000/- (Rupees Three Lakh Twenty Five Thousand) would be paid in installments within a total period of six months. It has also been agreed that the parties would file a mutual consent divorce application u/s 13B of the Hindu Marriage Act before the Family Court and on the date of admission of the said case, the petitioner would deposit the last installment of Rs. 1,00,000/- (Rupees One Lakh) in the Family Court which would be released in favour of the complainant on the date of grant of decree of divorce.
5. In such view of the compromise being arrived at between the parties, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of
Patna High Court CR. MISC. No.31676 of 2024(7) dt.06-05-2025 3/3 the like amount each to the satisfaction of learned ACJM, Patna City in connection with Complaint Case No. 1142 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/482 (2) of the BNSS, 2023.
6. It is expected that both the parties would strictly adhere to the terms that they have agreed upon and the informant is also directed to withdraw the criminal case against the petitioner within a period of six months.
