17-10-2017 Heard Sri Mukesh Kumar, learned counsel for the petitioner and Sri Rana Randhir Singh, learned Addl. Public Prosecutor.

Two petitioners, apprehending their arrest in Hajipur Town P.S. Case No. 548 of 2017 registered for offence under Sections 30, 38, 47 of the Bihar Prohibition and Excise Act, 2016 and Sections 188, 420, 120(B) of the Indian Penal Code, have prayed for grant of bail in the event of their arrest or surrender.

It was submitted by learned counsel for the petitioners that a raid was conducted in a house of one Lalbabu Rai and petitioners were made accused as if they fled away from the place of occurrence. Besides this, it has been argued that

Patna High Court Cr.Misc. No.48414 of 2017(2) dt.17-10-2017 2/2 petitioners are having clean antecedent, which fact has been stated in paragraph - 3 of the petition.

In view of facts and circumstances as well as clean antecedent, in the event of arrest or surrender within a period of six weeks from today, let both petitioners namely Arvind Rai and Raja Rai be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IIcum-Special Judge (Excise Act), Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 548 of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C.
