The petitioners being the brother and brother's wives are apprehending their arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after two years of the marriage for non-fulfillment of the dowry demand and disposal of the dead body. It is submitted by learned counsel for the petitioners that though the informant reached to the cremation
Patna High Court Cr.Misc. No.55549 of 2015 (2) dt.08-12-2015 2/2 place and by that time the dead body was almost cremated. It is further submitted that petitioner no. 1 resides in Saudi Arab and has no communication with the husband of the victim, moreover, thrust of accusation against the husband of the victim. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the their event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 6th Additional Chief Judicial Magistrate, Siwan in connection with Barhariya P.S. Case No. 280 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
