====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-10-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Nayagaon P.S. Case No. 03 of 2020 registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that the he along with other co-accused caught hold of Ravi Yadav when he arrived near the cattle shed of Manoj Yadav during his arrival to his house from Balahpur. Thereafter, Tinku Jha with a pistol fired at Ravi Yadav. Receiving injury on temple, he fell down on the ground.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that similarly situated co-accused has been
Patna High Court CR. MISC. No.23719 of 2020(3) dt.19-10-2020 2/2 granted bail vide Cr. Misc. No.25758 of 2020. He further submits that the petitioner is in jail custody since 18.02.2020. Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned Sri Ravi Ranjan, J.M. 1st, Begusarai in connection with Nayagaon P.S. Case No. 03 of 2020.
