1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Jagdishpur P.S. Case No. 72 / 2024 dated 07.08.2024 registered under Sections 126(2) / 115(2) / 109(i) / 303 (2) / 352 / 3(5) of the B.N.S. 2023.
3. As per the first information report due to irrigation of land scuffle took place between the parties in which the petitioner along with other accused persons assaulted the informant with fists and slaps. Subsequently it has been alleged that co-accused Golu Kumar assaulted the informant by the handle of pumping set on his head causing head injury. The petitioner along with the co-accused Sanjay Kumar pressed the neck of the informant.

4. Learned counsel for the petitioner submits that both the parties are co-villagers and there was a dispute regarding irrigation of land between them. The allegation against the petitioner is general and omnibus in nature of assaulting the informant by fists and slaps whereas there is specific allegation of assault by hard and blunt substance upon co-accused / Golu Kumar. The co-accused / Sanjay Kumar having similar allegation has been granted anticipatory bail by a co-ordinate bench of this court in Cr. Misc. No. 80346 / 2024 (AnnexureP/2).
5. Regard being had to the submission made by the parties, taking into consideration the fact that similarly situated co-accused has been granted anticipatory bail and the petitioner has clean antecedent, accordingly, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bettiah, West Champaran / successor court in connection with Jagdishpur P.S. Case No. 72 / 2024 subject to
