The present modification application has been filed stating therein that the petitioner had filed two writ applications bearing C.W.J.C. No. 4617 of 2021 and C.W.J.C. No. 5004 of 2019. While disposing C.W.J.C. No. 4617 of 2021,

Patna High Court MJC No.1125 of 2023(2) dt.17-05-2023 2/2 inadvertently, the another writ application, bearing C.W.J.C. No. 5004 of 2019, which was preferred against the order of punishment of censure and stoppage of three increments inflicted upon the petitioner has also been mentioned along with C.W.J.C. 4617 of 2021.

From the oral judgment dated 20.12.2022, passed in C.W.J.C. No. 4617 of 2021, it reflects that the same has been passed only in C.W.J.C. No. 4617 of 2021 and thus the said oral judgment dated 20.12.2022 is hereby confined only to C.W.J.C. No. 4617 of 2021.

It is made clear that C.W.J.C. No. 5004 of 2019 has not been disposed of along with C.W.J.C. No. 4617 of 2021. Hence, the office is directed to place C.W.J.C. No. 5004 of 2019 before the appropriate Bench for proper consideration of the matter.

Accordingly, the order dated 20.12.2022 is modified to the extent mentioned hereinabove.
