2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution is that the petitioner along with others was found near the father of the informant, who was sleeping near the community center. It is alleged that one Kalicharan Choudhury, fired at his father due to which he died.
4. Learned counsel for the petitioner has submitted that from perusal of the F.I.R., it is clear that the specific
Patna High Court CR. MISC. No.25481 of 2025(2) dt.02-05-2025 2/2 allegation is against one Kalicharan Choudhury. There is no allegation against the petitioner as he is only the member of the mob . It is also been submitted by learned counsel that the petitioner that similarly situated accused persons have been granted bail by learned Co-ordinate Bench vide order dated 23.05.2022 and 27.07.2022 respectively passed in Cr. Misc. No.4922 of 2022 and Cr. Misc. No.6949 of 2022. The petitioner is in custody since the 05.06.2023. The case of this petitioner stands on similar footing.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Amdabad P.S. Case No.208 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Katihar.
