The petitioner apprehends his arrest in Chautarwa (Bathwariya) P.S. Case No. 61/16 registered under Sections 304(B), 201/34 of the Indian Penal Code.
The informant alleged that he married his sister Rabita Devi with Raghvendra Yadav, son of Lalman Yadav of Village Jaunitola, P.S. Bathuwariya, District West Champaran, four years ago. His sister has got a child. When he went to the house of his sister on 25.02.2016, the mother-in-law of his sister was quarreling with his sister due to non-fulfillment of demand of dowry. The family members did not allow his sister to come along with the informant on the eve of Gauna of his sister. When the informant again went to the house of the accused persons, his sister was missing.
Patna High Court Cr.Misc. No.39719 of 2016 (2) dt.17-09-2016 2/2 Learned counsel for the petitioner submits that the petitioner is the brother-in-law of Raghvendra Yadav, the husband of the deceased. There is no allegation of demand of dowry and torture against the petitioner. The petitioner is living in his house with his wife and he has no manner of concern with Raghvendra Yadav or his wife, the deceased.
Considering the facts that the petitioner is the brother-in-law of the husband of the deceased and no serious allegation is made against the petitioner except that the name of the petitioner figured in the FIR, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st A.C.J.M., Bagaha, West Champaran in Chautarwa (Bathwariya) P.S. Case No. 61/16, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
