The petitioner apprehends his arrest in connection with Laukahi P. S. Case No. 143 of 2017 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise (Amendment) Act, 2016.
Allegedly, co-accused Ram Narayan Vishwakarma was apprehended with motorcycle and after search 45 liters of wine was recovered and he stated the name of the petitioner that the petitioner succeeded in fleeing away and both are indulged in that business.
Submission is of false implication and that besides the disclosure made by co-accused, there is no other material
Patna High Court Cr.Misc. No.4925 of 2018(2) dt.07-02-2018 2/2 against the petitioner, the petitioner has got no concern with Ram Narayan Vishwakarma, he has falsely named the petitioner and as such the petitioner deserves sympathetic consideration as he had no criminal antecedent.
Learned APP opposes the prayer of pre-arrest bail of the petitioner.
In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II, Madhubani in connection with Laukahi P. S. Case No. 143 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
