This application for grant of anticipatory bail arises out of Hawai Adda P.S. Case No. 133 of 2012, disclosing offence under Sections 7, 11, 46 and 47 of the Custom Act, 1962, 3(2) Foreign Trade (Development and Regulation) Act and Sections 353, 356 and 386/34 of the Indian Penal Code. Considering the circumstance that the First Information Report was lodged in the year 2012 and the petitioner's application for grant of anticipatory bail was rejected by the court of learned Sessions Judge, Patna on 03.10.2013, I am not inclined to entertain this application for grant of anticipatory

Patna High Court Cr.Misc. No.42392 of 2016 (3) dt.20-10-2016 2/2 bail which has been filed nearly three years after rejection of anticipatory bail application by learned Sessions Judge. Accordingly, this application for anticipatory bail is, hereby, rejected.

The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
