Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with S. Tr. No. 1016 of 2022 arising out of Dhanarua P.S. Case No. 167 of 2022 dated 03.04.2022 lodged under Sections 498A and 304B/34 of the I.P.C.

As per prosecution, the allegation against the petitioner is that he tortured his wife and for dowry killed her. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that the deceased wife was resident of town and could not adjust her in the village due to which she became frustrated

Patna High Court CR. MISC. No.27409 of 2023(2) dt.06-06-2023 2/2 and suicide. Counsel further submits that antecedent of the petitioner is clean and he is in custody since 13.04.2022. Counsel further submits that petitioner is unfortunate husband who is basically the victim in this case.

Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation in the F.I.R. which constituted the offence under section 498A as well as 304B of the I.P.C.

In the present facts and circumstances, I am not inclined to grant bail to the petitioner. Therefore, the bail petition of the petitioner is hereby rejected. Trial Court is directed to expedite the trial within 9 months.
