JUSTICE SANJAY PRIYA ORAL ORDER 01-09-2017 Heard learned counsel for the petitioner and leaned Additional Public Prosecutor of the State.

The petitioner is apprehending his arrest in connection with Khusharupur P.S.Case No. 112 of 2012 registered for offences punishable under Sections 363 and 365/34 of the Indian Penal Code.

Earlier by the order dated 04.03.2014, passed in Cr. Misc. No. 49341 of 2013, the prayer for anticipatory bail was rejected by this Court. The petitioner was at that time directed to surrender before the Court below but the petitioner did not surrender and after three years the petitioner has again filed petition for anticipatory bail.

Considering such conduct of petitioner, this Court is not

Patna High Court Cr.Misc. No.40330 of 2017 (2) dt.01-09-2017 2/2 inclined to grant the privilege of anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected with a direction to the petitioner to surrender in the Court below within four weeks from today and make a prayer for regular bail, the same shall be considered on its own merit without being prejudiced by this order.
