The petitioner seeks bail in a case registered under Sections 409, 420, 424, 120(B) of the Indian Penal Code. Allegation against the petitioner is that he defalcated government money of Rs.18,74,012/-.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that the petitioner and others have misappropriated public money of Rs.18,74,012/-. Other co-accused had been granted bail with condition that he will deposit Rs.6 lacs. It is further submitted that the petitioner is also ready to deposit an amount of Rs.6 lacs in

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, petitioner is directed to deposit an amount of Rs.6 lacs in the court below within a period of two months, which will be subject to the final disposal of the case. Let the petitioner, above named, be released on provisional bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. case No.277 of 2018. If the petitioner deposits the aforesaid amount in the court below, the provisional bail granted to the petitioner will be confirmed by the court below itself.

If the petitioner fails to do so, the court below will be at liberty to cancel the provisional bail granted to the petitioner. Narendra/- (Sudhir Singh, J) U T
